Introduction

HealthMatters.io LLC (“www.HealthMatters.io”) is a web-based and software application mobile-based, personalized digital health platform. These terms of use apply to any use (i.e., web-based or mobile-based) of HealthMatters.io LLC’s services. It includes the following components:

Voluntary participation

Your use of the HealthMatters.io service is voluntary. It is your choice whether to participate or not. You may cancel the service at any time. If for any reason you believe that your use is anything but voluntary, please terminate all use of the service.

Procedures and protocol

As part of the process we will collect some information from you. The information collected will include general contact information, age, gender, general health information including information about your diet, vitamins and supplements you take, your physical activities and other important details about yourself.

No medical advice

The information provided by HealthMatters.io LLC is for purposes of tracking your health and wellness only and is not intended to provide medical advice, diagnosis, or treatment. These interactions are not intended to create, nor do they create, any doctor-patient relationship. You should seek the advice of a physician or other qualified health provider with whom you have such a relationship if you have questions regarding any medical or psychiatric condition or if you are experiencing any symptoms of or believe you may have any medical or psychiatric condition, regardless of any information contained within HealthMatters.io. You should not ignore professional medical advice or delay in seeking it because of HealthMatters.io recommendations. Furthermore, you should not interpret your HealthMatters.io results or any other communications from HealthMatters.io LLC as recommending any specific treatment plan, product or course of action. You should always consult your physician or other qualified health provider before starting any new treatment or stopping any treatment that has been prescribed for you by your physician or other qualified health provider.

Additional scope

We may incorporate different or additional technologies to collect or test data in the future.

Cost

You are paying for the HealthMatters.io services with your personal funds and any third-party payers will not pay for or reimburse you for these costs. HealthMatters.io will not submit any information provided by you for reimbursement or payment from private insurance carriers, Medicare, Medicaid, or any other third-party payers. We are not able to offer refunds.

If you decide to use our professional uploading service, we do charge $15 per report upload. This cost item is charged in addition to your subscription fee.

Payments and refunds

You warrant that the information you provide is accurate and that you have the legal authority to furnish account and debit information for electronic payments on your account. User acknowledges and agrees that if User's payment cannot be processed for any reason, HealthMatters.io may suspend or cancel User's Subscription or Services.

This Agreement is effective until the applicable Subscription Term for the Service(s) has expired or the Subscription is terminated as expressly permitted herein. 

By agreeing to any Subscription Documentation, User is agreeing to pay applicable fees for the entire Subscription Term. User cannot cancel or terminate a Subscription Term except as expressly permitted herein.

Annual subscription: Upon the expiration of the Initial Subscription Term, the Subscription will automatically renew to subsequent twelve (12) month renewal terms (“Renewal Term(s)”) unless: (i) otherwise stated on the applicable Subscription Documentation or (ii) either party gives written notice by sending an email to HealthMatters.io at help@healthmatters.io of non-renewal at least thirty (30) days before the end of the then-current Subscription Term. User will be charged a renewal rate equal to the rate for the immediately preceding Subscription period, based upon the Subscription Documentation that User has agreed to, unless HealthMatters.io has notified User of any new rate in advance.

Monthly subscription: Upon the expiration of the Initial Subscription Term, the Subscription will automatically renew to subsequent one (1) month renewal terms (“Renewal Term(s)”) unless: (i) otherwise stated on the applicable Subscription Documentation or (ii) either party gives written notice by sending an email to HealthMatters.io at help@healthmatters.io of non-renewal at least five (5) days before the end of the then-current Subscription Term. User will be charged a renewal rate equal to the rate for the immediately preceding Subscription period, based upon the Subscription Documentation that User has agreed to, unless HealthMatters.io has notified User of any new rate in advance.

HealthMatters reserves the right to collect fees, surcharges or costs incurred before you cancel your account(s) or a particular subscription. In the event that your HealthMatters account or a particular subscription is terminated or cancelled, no refund will be granted, and you will have no further access to your account or anything associated with it. Any delinquent or unpaid accounts must be settled before HealthMatters may allow you to create any new or additional accounts.

Benefits

If you participate in the HealthMatters.io services, you may or may not experience benefits. Potential benefits may include better health and/or wellness.

Confidentiality

The information that we collect as part of the HealthMatters.io services will be kept confidential and will only be identified by an anonymous number. Information about you that will be collected will be secure and nobody but HealthMatters.io LLC's qualified staff or authorized partners will be able to see it. The information will not be shared with or given to anyone without your written consent.

Right to refuse or withdraw

You do not have to take part in this service if you do not wish to do so. You may also stop participating at any time you choose. It is your choice and all of your rights will still be respected.

Indemnification

You agree to indemnify, defend and hold harmless HealthMatters.io LLC, its licensors, suppliers, and their respective directors, officers, employees, agents, affiliates, successors and assigns, from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees) and other expenses that arise from your participation in the HealthMatters.io services.
